    Listing Agent vs. Selling Agent: Who Does What?

    There is often confusion about titles in a real estate transaction. In Massachusetts, understanding who represents whom is vital for protecting your interests.

    The Listing Agent: The Seller's Advocate

    The listing agent (or seller's agent) is hired by the homeowner to market and sell the property.

    Goal: Get the highest price and best terms for the seller. Duty: Owe undivided loyalty to the seller.

    The Selling Agent: The Buyer's Advocate

    Confusingly, the agent who brings the buyer is called the Selling Agent. In modern terms, they are usually referred to as the Buyer's Agent.

    Goal: Find the right home and negotiate the best deal for the buyer. Duty: Owe undivided loyalty to the buyer.

    What is Dual Agency?

    This occurs when one agent represents both sides. In MA, this requires written consent from both parties. Be careful; a dual agent must remain neutral and cannot advise on price.
