Selling an Inherited Home in Massachusetts: The Order of Operations

Two things determine whether an inherited Massachusetts home sale goes smoothly: establishing who has legal authority to sell, and getting a date-of-death valuation before anything is changed or removed. Both should happen early — nearly every expensive problem in an estate sale traces back to one of them being skipped.

This is also a sale that happens while people are grieving, often with siblings who disagree, on a house full of a lifetime's belongings. The guidance below assumes that context rather than pretending otherwise.

Who Has Authority to Sell?

It depends entirely on how the property was held, and this is the first question to answer.

• Held in a trust: the trustee generally has authority to sell under the trust's terms, without probate. This is the cleanest path and the reason estate planning attorneys recommend it.
• Held jointly with rights of survivorship: ownership passes to the surviving owner by operation of law. No probate is needed for the transfer.
• Held individually: the property goes through probate in the Massachusetts Probate and Family Court for the county where the decedent lived. A personal representative must be appointed before the property can be sold, and the authority they receive depends on the type of appointment. Informal probate is faster; formal probate may be required where there is a dispute, an unclear will, or an unlocatable heir.

Until authority is established, you cannot convey clear title — and a buyer's attorney will not let a closing happen without it. Start the process before you start preparing the house.

Get a date-of-death appraisal from a licensed appraiser as early as possible. Inherited property generally receives a stepped-up basis to its fair market value at the date of death, which can eliminate decades of accumulated gain. Without a documented valuation, you are relying on a reconstruction later, and the person who loses is whoever pays the tax.

Why Does the Stepped-Up Basis Matter So Much?

Because it is usually the difference between a large tax bill and none at all.

If a parent bought a Newton house decades ago and it is worth many multiples of that today, an heir who sold using the original basis would face an enormous gain. With the step-up, the basis resets to the value at the date of death — so a sale shortly afterward often produces very little taxable gain.

That makes the date-of-death appraisal one of the highest-value documents in the entire process, and it needs to reflect the property as it was, before anyone cleans it out, repairs anything, or updates it. Do it first.

What If the Heirs Disagree?

Common, and worth addressing directly rather than hoping it resolves. Disagreements are usually about one of three things:

• Whether to sell at all — a legal question about ownership rights.
• What the price should be — answerable with data; get an appraisal and comparable sales, and let a document rather than a sibling make the argument.
• Who does the work — worth naming out loud, because the heir who lives nearest almost always does more, and resentment about that surfaces later disguised as an argument about price.

Where an agreement genuinely cannot be reached, Massachusetts law provides for a partition action, in which a court orders a sale and divides the proceeds. It is slow and expensive, and it exists as a backstop rather than a plan.

Is It Better to Sell or to Keep It?

An honest analysis compares the property's market value against what it actually earns — after taxes, insurance, maintenance, and the value of the time someone will spend managing it. Sentiment is a legitimate factor and should be named as one rather than dressed up as an investment case.
